Halle Berry's alleged stalker has been charged with burglary.

Richard Anthony Franco, 27, was charged with felony stalking after he was arrested earlier this month for trespassing on the actress' property three times in three days and the Los Angeles District Attorney's Office have now added the additional charge.

As with the stalking accusation, Franco - who is currently on probation in a separate misdemeanour battery case - pleaded not guilty to burglary, which carries a six-year prison term.

He is currently behind bars with bail set at $150,00, while Halle has also obtained a restraining order against him which states he must stay 500 yards away from her, her family and her home and bars him from attempting to contact her for three years.

A preliminary hearing has been set for August 4.

At the original hearing earlier this month, Deputy Public Defender Ken Star, said the 'X-Men' star was "very shaken and showed signs of stress" when police asked her to identify Franco when he was arrested at her home.

Following the first two incidents when Franco tried to scale a wall into her property, Halle hired a team of armed security officers to protect her home, and it was them who alerted her to his third appearance, instructing her to "get to safety as quickly as possible" with her three-year-old daughter Nahla, court filings show.
