Expert praises intra-party management rules

BEIJING - A law professor has praised new efforts to regulate the formation of the Communist Party of China (CPC) rules.

The CPC Central Committee published two documents on Monday that will help regulate the formation of CPC rules, which act as a form of legislation within the CPC, in order to improve internal management and sharpen intra-party supervision.

The documents will help the CPC improve the governance in accordance with the law, said Jiang Ming'an, a professor from the Law School of Peking University, in an article published in the Friday edition of the People's Daily, the CPC's flagship newspaper.

One of the documents details which CPC organs are authorized to draft, approve, publish, amend and abolish CPC regulations and what procedures they should follow. The other describes how CPC regulations should be recorded, reviewed, amended or abolished.

The regulations are the first of their kind to be created since the CPC was founded in 1921. They will affect more than 82 million members and four million CPC organs.

Since the CPC is not part of the government, the country's administrative rules don't apply to the internal affairs of the CPC, such as its leadership system, organization and supervision, he said.

While the CPC is governing the country, it should act within the limits of the Constitution and relevant laws, he said.

The intra-party rules are in place to regulate the CPC in areas that are not covered by law, the professor said.

The regulations embody the CPC's efforts to follow the principle of the rule of law and prevent the wanton issuance of CPC orders, he said.

"For example, one of the provisions requires all intra-party rules to be formulated on the basis of observing the country's Constitution and law, or they would be declared null," he said.

Jiang also mentioned content that highlights efforts to solicit opinions from CPC members, experts and citizens before promulgating a new regulation, adding that this will ensure scientific and democratic decision-making within the CPC.
